These Terms govern your use of The Selling Studio (the "Service"), provided by Donna McNiel, Art and Resistance ("we", "us"). By creating an account or using the Service you agree to these Terms. If you don't agree, please don't use the Service.
1. The Service
The Selling Studio is an AI-powered marketing copy tool for artists and hobbyists. You enter information about your work and the Service generates social media captions, product descriptions, and email copy. Access is sold as a one-time lifetime purchase.
2. Your Account
You must provide accurate information when signing up and keep your login credentials confidential. You are responsible for everything that happens under your account. You must be old enough to form a binding contract in your jurisdiction.
3. Acceptable Use
You must not use the Service to:
- break any law or infringe anyone's rights, including intellectual property;
- generate illegal content, hate speech, harassment, sexual content involving minors, deepfakes of real people without consent, or malware;
- attempt to jailbreak, reverse engineer, scrape, probe, or interfere with the Service or its security;
- resell, redistribute, or share access to the Service with others.
4. AI-Generated Content
You are responsible for the prompts you submit and how you use the outputs. You confirm you have the rights to any information you enter about your work. AI outputs can be inaccurate, biased, or unsuitable for a given purpose — review them before publishing, and do not rely on them as professional, legal, financial, medical, or tax advice. Subject to your compliance with these Terms, you own the outputs generated for your account, to the extent ownership is possible under applicable law. We may moderate, filter, restrict, or refuse outputs, and we may suspend accounts that repeatedly violate these Terms. If you believe content generated through the Service infringes your rights, contact us and we will investigate and act where appropriate.
5. Intellectual Property
The Service, its software, branding, and documentation are owned by Donna McNiel, Art and Resistance. We grant you a limited, non-exclusive, non-transferable right to use the Service for your own creative work. Nothing in these Terms transfers ownership of the Service to you.
6. Payments
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation and refund mechanics are governed by Paddle's Buyer Terms. See our Refund Policy.
7. Service Availability
We work hard to keep the Service running, but we do not guarantee it will be uninterrupted, error-free, or always available. The Service is provided "as is" and "as available", and to the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
8. Suspension & Termination
We may suspend or terminate your access if you materially breach these Terms, misuse the Service, create security or fraud risk, or repeatedly violate the Acceptable Use rules.
9. Liability
To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the amount you paid us in the 12 months before the event giving rise to the claim. We are not liable for indirect, consequential, or special damages (including loss of profits, revenue, data, or goodwill). Nothing in these Terms excludes liability for fraud, death, or personal injury where the law does not allow such exclusions.
10. Changes
We may update these Terms from time to time. If we make material changes we will notify you through the Service or by email. Continued use after changes means you accept the updated Terms.
